
Terms of Service.

These Terms of Service ("Terms") govern the provision of coaching, mentoring and consulting services ("Services") by Lucy Mackenzie Coaching ("the Coach") to her clients ("the Client"). By engaging Lucy Mackenzie Coaching, the Client agrees to these Terms.
1. Duration and Scope
These Terms come into effect upon agreement to commence Services and will remain in effect until Services are concluded or terminated as outlined below.
2. Services Offered
The Coach offers coaching, mentoring, and consulting Services, either in-person or remotely, as mutually agreed. Specific Services, format, and outcomes will be detailed in writing before commencing work.
3. Delivery and Schedule
The Coach and Client will agree on session dates and format in advance. The Coach does not require access to the Client's IT infrastructure.
4. On-site or Remote Services
The Coach agrees to adhere to any applicable policies at the location of service, including health and safety if on-site, and remote platform policies when services are delivered online (e.g. Zoom, Teams).
5. Fees and Cancellations
Fees and payment schedules are agreed in advance. Invoices will be issued in line with that agreement and are payable within 30 days.
Cancellations:
Sessions under one day: 48+ hours notice = no charge; 24–48 hours = 50% charge; under 24 hours = full charge
Full-day sessions or group events: 7+ days notice = no charge; 3–7 days = 50% charge; under 3 days = full charge
6. Intellectual Property
Pre-existing intellectual property remains the property of the Coach. All client-specific documentation created during the Services will be shared with and for the use of the Client.
7. Confidentiality
Both the Coach and Client agree to maintain confidentiality. Session content is private unless disclosure is legally required or necessary to prevent harm or criminal activity.
8. Data Protection
Lucy Mackenzie Coaching complies with the UK GDPR and the Data Protection Act 2018. Personal data collected is used solely for the purposes of delivering Services and will not be shared without consent unless required by law.
9. Professional Standards
Lucy Mackenzie Coaching abides by the EMCC Code of Ethics and maintains full professional accreditation. Services are delivered with due care, skill, and diligence.
10. Liability
To the extent permitted by law, Lucy Mackenzie Coaching shall not be liable for any indirect, incidental, or consequential losses. Liability for direct damages is limited to the total amount paid for Services.
11. Termination
Either party may terminate the agreement with 30 days’ written notice. Fees for completed Services will still be payable. Termination for breach may occur if not resolved within 10 working days of written notice.
12. Force Majeure
Neither party will be liable for delays or failures caused by events beyond their reasonable control (e.g. natural disasters, illness, internet outage).
13. Insurance
Lucy Mackenzie Coaching maintains appropriate Professional Indemnity Insurance.
14. Governing Law
These Terms shall be governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
